The following General Terms and Conditions of Sale govern the offer and sale of products on our web site and any order placed via our catalogue("www.coolibareu.com and www.proteksol.com ").
The products purchased on www.coolibareu.com or www.proteksol.com are sold directly by Proteksol CH sagl “Proteksol”, with registered office in Switzerland, business register number: CH 51440205931, tax code and VAT number: 680497 – Austria TVA (AU) 384/7669 et UID (TVA) ATU65506357.
Our contract with you
After you have placed your order we will send you an order acknowledgement by email, fax or postal services. Our acceptance of your order and completion of our contract with you does not take place until the goods are dispatched to you. We will not be held wholly or partly responsible for any circumstances beyond our reasonable control, which cause the delay or failure to deliver the goods or services, or to comply with any other obligation.
Prices are subject to change. Check the final price of sale before sending the relevant order form.
Orders made from a Country site different from the one you are shipping to, or to addresses to which the Vendor cannot ship, will be automatically cancelled. We will send you an email request to use the correct country site.
We charge a variable amount of money for the packing and delivery of goods. This charge varies according to the size of your order and your delivery location. When goods are in our warehouse and are in stock we deliver within 5-20 working days of approving your order. If delivery is likely to be longer, we will give you a likely delivery date. If, for example, an item is unavailable, we may inform you of an alternative. We reserve the right to accept in part or in full, or decline, any order or request for credit.
Customs and Duties
Upon arrival in your Country the contents of your order may likely be subject to Customs fees (taxes, duties, processing fees, brokerage fees, etc.), which are responsibility of the person(s) receiving the order. These fees are not under the Vendor’s control For this reason we recommend you verify with your local Customs office before you place an order. The Vendor is unable to estimate customs fees, taxes, duties, etc. so please contact your local authorities or Customs office for detailed information.
All products sold by Proteksol CH sagl are delivered duty free only within the European community.
Both the item prices as well as the shipping charges you pay to the Vendor do NOT include Customs fees, import taxes, brokerage fees, or duties.
Should you refuse your order at the time of arrival or should you refuse to pay the Customs fees when your order arrives, the shipment will be returned to the Vendor and we will be charged the customs fees plus return shipping costs. If you receive your order and accept to pay the Customs fees upon delivery, the Vendor will not issue refunds for the same in case of return of the purchased products.
Customs processing may delay the delivery of your order. Should you experience such delays please check with your local Customs offices. The invoice for the Customs fees could arrive weeks after you receive your order, separately from the same.
Your use of the products
All our products are for domestic use only. If you intend to use them for business, then you must check that they are suitable. You may also invalidate any warranty if the products are used for business purposes.
Using the product for domestic purposes: We will be responsible for any loss that you suffer as a result of a product’s failure, provided the reason for its failure was reasonably foreseeable by both you and us when the contract was completed.
Using the product for business purposes: We will not be responsible for any economic loss including, but not limited to, loss of profit, revenue, contracts, savings, loss of data, goodwill or reputation. Our maximum liability will be limited to the replacement value of the product.
Whether products have been used for domestic or business purposes, Proteksol CH sagl does not, by law, limit or exclude its liability for death or personal injury caused by negligence, breach of duty, gross negligence or willful misconduct. This clause does not affect your statutory rights as a consumer.
Returns and Exchanges
If you need to return or exchange a purchase, for any reason, send it within 30 days to RETURNS at the service address below. Refunds are issued in the same form as original payments. We cannot pay for return shipping.

For exchanges involving sun protective clothing items of equal or lesser value than your original purchase, we will ship the new item(s) back to you with the additional shipping or handling charges.
For returns, we will credit your original credit card for the item purchase price or send you a money transfer for the item purchase price - whichever was your original form of payment.

Order Codes
Order codes tell us which promotion or special offer you are entitled to claim with your order. The order code is for you personally, and remains the property of the company at all times. Unless stated otherwise, order codes can only be used once and discounts are not valid on Proteksol CH sagl’s Sale items. and certain internet only products indicated online. If you place more than one order using the same order code, your first order only will be accepted.
Trading Area and VAT
Our merchandise (except certain stated items) is for sale within Europe, Dubai, Israel, North Africa, Russia and all Eastern European countries. All prices do not include VAT unless the product is exempt. No discount will be given on products where VAT is not chargeable, nor accountable to HM Customs&Excise or similar authority within the European Union. Where VAT is chargeable, we reserve the right to amend our prices to reflect any changes in VAT that may occur. The new price will be shown on the product page on the site, your order confirmation email and delivery note. For your convenience we also show the price with and without VAT .
Data Protection
When you place an order with us or request a catalog, we collect information from you that may include your name, address, telephone number, email address and credit card information. We maintain this information in a secure database on our server located in a certified non accessible secure area. We may combine this information with data that is publicly available and data that we receive from other reputable sources whose policies meet the Direct Marketing national legal privacy standards.
From time to time, we may mail and/or email you educational information about sun protection and/or updates on new Coolibar sun protection clothing styles and promotions. We never exchange this information with third party organizations without your written prior consent. We do not share email addresses with any other company or organization.

Consumer Protection (Distance Selling) Regulations
All home shopping companies must give a minimum of 7 days in which customers can cancel or return any item in their order. To make shopping easier for you, Proteksol CH sagl has extended this period to 30 days.

The use of Trademarks advertising our merchandise should not be taken as indicating the merchandise’s country of origin.

We reserve the right to amend these terms and conditions if necessary. You will be subject to the terms and conditions at the time that you use the website unless any change is required by law or government authority. If any of these terms and conditions is deemed invalid or unenforceable by any competent authority, that condition will be removed. This will not affect any of the remaining terms and conditions. Any delay or failure by us to exercise our legal rights within our contract with you should not be seen as a waiver of our legal rights. These terms and conditions and the contract between you and us will be governed by the laws of England and any disputes will be resolved exclusively in the English courts.

Every sun protection clothing item we offer is tested and rated for its UV protection level. We show the percentage UV blocked in the text beside each product in our catalog and on this web site. For sunscreens, we show the SPF rating. We also place a hang tag with the percentage UV blocked and the UPF rating on every garment we manufacture.
Our UV testing of fabrics significantly exceeds all published American standards.
- UV transmittance tests are performed according to the American Association of Textile Chemists and Colorists Test Method 183 (AATCC 183);
- Fabrics are tested both before and after life cycle exposure to laundering, sunlight, and chlorinated water according to American Society for Testing and Materials D 6544 (ASTM D 6544);
- Garments are then labeled according to the guidelines specified in American Society of Testing and Materials D 6603 (ASTM D 6603).
Coolibar performs this testing for multiple samples from every dye lot of every fabric used in production of all Coolibar sun protection clothing items.

Governing Law
These General Terms and Conditions of Sale are governed by Swiss law governing commerce and e-commerce.
Amendments and updates
The General Terms and Conditions of Sale may be amended from time to time due to new laws and regulations or other reasons. The new General Terms and Conditions of Sale shall be effective as of the date of publication on www.proteksol.com .
